Terms of Service

Agreement

These Terms of Service (“Terms”) are a legal agreement between you and Frydai, operated as a business of 187n.ai(“we”, “us”). By purchasing a subscription, creating an account, completing setup, or using Frydai, you agree to these Terms. If you do not agree, do not use the service.

The service

Frydai provides a private AI operator for e-commerce businesses. After subscription, you complete a setup wizard, connect your Telegram bot and API keys, and we provision a dedicated runtime environment for your operator. You interact with Frydai primarily through Telegram; a dashboard is available for configuration, credentials, and billing-related information.

Frydai includes slash-command skills for tasks such as research, ad creatives, Shopify operations, and landing-page generation. Actions that involve spending money or publishing externally may require your explicit confirmation in chat.

Eligibility

You must be at least 18 years old and able to enter a binding contract. If you use Frydai on behalf of a company, you represent that you have authority to bind that company to these Terms.

Subscription and billing

• Frydai is offered as a subscription (€147 / 4 weeks) through Whop, our payment and membership platform.
• Subscriptions renew automatically unless cancelled through Whop before the next billing period.
• Prices, taxes (including EU VAT where applicable), and billing intervals are shown at checkout and may change with reasonable notice for future periods.
• Refunds, if any, are handled according to Whop's policies and applicable consumer law.

Your accounts and API keys

Frydai is a “bring your own key” product. You are responsible for:

• Creating and securing your Telegram bot via BotFather
• Providing valid API keys (OpenAI is required; other integrations are optional)
• All fees charged by third-party providers (OpenAI, Shopify, Meta, HiggsField, and others)
• Compliance with each third party's terms of service and platform policies
• Maintaining accurate business profile and connection settings in Frydai

You must not share dashboard access or API credentials in a way that compromises your account or other customers' security.

Acceptable use

You agree not to use Frydai to:

• Break any applicable law or third-party terms
• Send spam, malware, or deceptive or harmful content
• Infringe intellectual property, privacy, or other rights
• Attempt to probe, scan, or compromise Frydai infrastructure or other customers' environments
• Reverse engineer or resell the service except as expressly permitted
• Generate or distribute content that is illegal, hateful, or clearly abusive

We may suspend or terminate access if we reasonably believe you have violated these Terms or pose a risk to the service or other users.

AI outputs and business decisions

Frydai uses AI to assist with e-commerce workflows. Outputs may be inaccurate, incomplete, or unsuitable for your specific situation. You are solely responsible for reviewing content, ads, listings, and operational actions before publishing or relying on them. Frydai does not guarantee revenue, ad performance, rankings, or business results.

Intellectual property

• Our IP — Frydai software, branding, documentation, and the underlying platform remain our property or that of our licensors.
• Your content — you retain ownership of your business information, prompts, and materials you provide. You grant us a limited licence to host, process, and transmit that content solely to operate the service.
• Generated output — subject to your third-party agreements and applicable law, you may use outputs produced for your account in your business. We do not claim ownership of your generated creatives or copy.

Availability and changes

We aim for reliable service but do not guarantee uninterrupted or error-free operation. Maintenance, third-party outages (Telegram, OpenAI, Shopify, etc.), or infrastructure events may cause downtime. We may modify, add, or remove features with reasonable notice where practicable.

Termination

You may cancel your subscription at any time through Whop. We may suspend or terminate your access for non-payment, breach of these Terms, or legal requirement. Upon termination, your right to use Frydai ends. Provisions that by nature should survive (payment obligations, disclaimers, liability limits) will survive.

Disclaimer of warranties

Frydai is provided “as is” and “as available” to the fullest extent permitted by law. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the maximum extent permitted by law, 187n.ai and Frydai will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill. Our total liability for any claim relating to the service is limited to the amount you paid to Frydai in the twelve (12) months before the event giving rise to the claim, or one hundred euros (€100) if you have not yet paid, whichever is greater.

Nothing in these Terms limits liability where it cannot be limited under applicable law (including for death or personal injury caused by negligence, or fraud).

Indemnity

You will indemnify and hold harmless 187n.ai and Frydai from claims, damages, and expenses (including reasonable legal fees) arising from your use of the service, your content, your connected third-party accounts, or your violation of these Terms or applicable law.

Governing law

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law rules. Disputes shall be submitted to the competent courts in the Netherlands, unless mandatory consumer protection rules in your country require otherwise.

Changes to these Terms

We may update these Terms from time to time. We will post the revised version on this page with an updated date. Material changes will be communicated where required by law. Continued use after changes take effect constitutes acceptance.
